New Form Replaces CARES Act Affidavit

Last week Chief Justice Newby allowed Emergency Directive 18 and 20 to expire. The Administrative Office of the Courts(AOC) has now replaced the CARES Act Affidavit with form 208. Use this form going forward.
 
Emergency Directive 20, which expands the statutory requirement that summary ejectment hearings must be heard within 7 days to 30 days, has not been addressed yet. The AANC have reached out to the AOC regarding further guidance regarding scheduling. For now, courts have been given the authority to manage proceedings as they see fit. We will continue to monitor how this will impact summary ejectment hearings across the state.
